(EFFECTIVE January 22, 2024)
THIS DOCUMENT IS A LEGALLY BINDING CONTRACT ISSUED BY THE LUXURY DESTINATIONS TRAVEL LLC AND ACCEPTED BY THE GUEST(S) SUBJECT TO THE TERMS AND CONDITIONS (“TERMS”) BELOW. BY COMPLETING A BOOKING AND/OR PAYING A DEPOSIT, THE GUEST ACCEPTS THESE TERMS AND ANY OTHER TERMS AND CONDITIONS PROVIDED DURING THE BOOKING PROCESS.
THESE TERMS CONTAIN IMPORTANT LIMITATIONS ON THE RIGHTS OF GUESTS. PLEASE READ ALL TERMS CAREFULLY.
This Website is provided to assist customers in creating tailor-made journeys, carefully crafted to deliver a personalized adventure.
The Luxury Destinations Travel LLC offers fully customized travel experiences, including but not limited to cruises, guided tours, villa rentals, train and other transportation arrangements. Each travel service or package is tailored to client preferences and is subject to these Terms and Conditions and to the terms set by third-party providers.
2.1 Any instructions or requests for information or services received by TLDT from you (the “Customer”) constitute your acknowledgement that you have received, understood, and agree to be bound by these Conditions and authorize TLDT to act on your behalf in arranging travel and related services (“Services”).
2.2 The person confirming a booking and paying the deposit warrants that they have the authority to bind all members of the party to these Conditions.
2.3 Payment of your deposit constitutes acceptance of these Conditions and forms a binding contract between you and TLDT. For bookings with age restrictions, you must be at least 18 years old and confirm that all group members meet the applicable age requirements.
3.1 Unless otherwise stated, all prices quoted by TLDT are subject to availability and may be withdrawn or varied without notice until a deposit is received and the booking is confirmed. Air-only prices are not guaranteed until full payment is received and tickets are issued.
3.2 A standard deposit equal to 30% of the total price of your travel program is required at the time of booking.
3.3 Certain components of your travel program (e.g., specific suppliers or premium services) may require a higher deposit than 30%. Any such requirements will be communicated in your quote.
3.4 For travel programs including a villa, a 50% deposit of the total program price is required at booking, plus a villa security deposit in the amount specified in your quote and invoice. The security deposit amount varies by villa and will be disclosed in your documentation.
3.5 If your reservation is made within 90 days of departure, the full cost of the trip is due at confirmation. For programs including a cruise, villa, or private jet, earlier deposit and/or balance due dates may apply; please refer to your specific quote and supplier terms.
3.6 We accept payments via credit card, certified check, wire transfer, or money order. Unless otherwise specified, the balance is due 90 days prior to departure. All payments with a credit/debit card, are subject to 3.5% card processing fee – cruise only bookings are excluded from this fee.
3.7 For River Cruises and/or Ocean Cruises, the balance is due 110 days prior to cruise departure.
3.8 For Expedition Cruises, the balance is due 150 days prior to cruise departure.
3.9 If any balance remains unpaid by the due date, and no alternative arrangement has been agreed with TLDT, we may treat your booking as cancelled and apply the cancellation charges described in Section 4.
3.10 All payments must be made in U.S. dollars.
3.11 TLDT applies a 3.5% card fee for custom itineraries as stated above at paragraph 3.6. You are responsible for any additional bank or credit card charges, including foreign transaction fees, and TLDT is not liable for such charges.
3.12 Except for TLDT’s own fees, all other monies received by us in respect of Services are received as agent for the relevant third-party service provider. If a third-party provider is unable to provide contracted services, your remedy lies against that provider, not TLDT. By paying via credit card, you agree not to initiate chargebacks against TLDT for such third-party failures.
3.13 Prices may change due to factors outside our or our suppliers’ control, including but not limited to: currency fluctuations, fuel surcharges, taxes, and fare increases. TLDT reserves the right to increase the price of your travel program due to (i) increased supplier costs, (ii) changes in tariffs and taxes, and (iii) foreign exchange fluctuations. TLDT may withdraw or alter tours, itineraries, or inclusions as necessary and pass on additional costs caused by delays or events beyond its control. Every effort will be made to operate tours as planned, but changes may occur after the final itinerary is issued.
3.14 Additional airport, hotel, car rental fees, and certain government taxes may not be included in your purchase and may be collected locally. Seat selection and similar optional services may incur additional fees.
4.1 Requested changes to your travel arrangements may incur additional fees from TLDT and/or suppliers, up to 100% of the booking cost as described below, regardless of whether travel has commenced.
4.2 Fees and extra charges may apply when bookings are changed and when tickets or documents are reissued.
4.3 If TLDT incurs supplier cancellation or change fees on your behalf, you agree to indemnify TLDT for those amounts.
4.4 IN THE EVENT OF A CRUISE, TOUR, PRIVATE JET, VILLA, OR LAND CANCELLATION, A USD $100 PER PERSON ADMINISTRATIVE FEE WILL BE ASSESSED BY TLDT, IN ADDITION TO ANY PENALTIES IMPOSED BY SUPPLIERS (INCLUDING CRUISE LINES, AIRLINES, TOUR OPERATORS, HOTELS, AND VILLAS).
4.5 You are also subject to any cancellation fees assessed by service providers, including without limitation hotels and villas, cruise lines, charter vessels, transfer providers, activity providers, rail suppliers, and airlines.
4.5.1 Land journeys:
4.5.2 Expedition Cruises:
4.5.3 River Cruises and/or Ocean Cruises:
4.5.4 The specific cancellation terms applicable to your particular cruise may differ from the general terms above and will be set out in your quote and booking documentation. It is your responsibility to review and understand the cancellation terms that apply to your cruise.
4.5.5 Villa rentals, full ship charters, yacht charters, and flight charters are subject to supplier-specific cancellation terms, which will be provided in your quote and booking confirmation.
We strongly advise you to purchase travel insurance, whether from TLDT or another provider, including at minimum medical, evacuation, and repatriation coverage of at least USD $200,000 for all travel dates with TLDT and any third-party operators in your program (“Medical Emergency Travel Insurance Coverage”).
We also strongly recommend trip cancellation insurance and baggage insurance. In the event of cancellation, such coverage may be your only source of reimbursement.
5.1 TLDT is currently authorized to sell travel insurance only to U.S. passport holders with a U.S. residential address. By purchasing insurance from TLDT, you represent that you meet these requirements and TLDT disclaims liability for any false or inaccurate representation.
5.2 It is your responsibility to ensure that all travelers in your party have adequate travel insurance for the journey.
5.3 If you decline to purchase travel insurance through TLDT, you acknowledge that TLDT has recommended or offered travel insurance protection, that you have chosen not to purchase such a policy from TLDT, and that TLDT will not be able to provide support in the event of a claim under any policy purchased from a third party.
6.1 Valid passports are required for international travel. Many countries require at least six months’ validity from the date of return and may require machine-readable passports. You must check with the appropriate consulate or embassy for current visa requirements.
6.2 You are solely responsible for obtaining all required travel documentation, including passports, visas, reciprocity fees, affidavits, immunizations, vaccinations, and any other documents required for entry, exit, and transit in all countries on your itinerary.
6.2.1 When assisting with international bookings, TLDT will assume that all travelers have valid passports and any required visas and documentation, unless you inform us otherwise.
6.3 TLDT does not provide legal or official advice on travel documents and does not warrant the accuracy or completeness of any information it may provide regarding visas, vaccinations, climate, clothing, baggage, or special equipment. You agree that TLDT is not responsible for errors or omissions in such information.
6.4 You agree that all information you provide, including personal information, may be shared with authorities and agencies responsible for immigration and aviation security. You must ensure that all names provided to TLDT match the travelers’ passports. Name changes, if permitted by the relevant supplier, may incur supplier penalties for which you will be responsible if the names you provided to TLDL were incorrect. Also, a copy of all travelers’ passports is required for international travel.
6.5 You are responsible for any customs duties or other charges imposed by government authorities in connection with your travel and may not make claims against TLDT for such duties or charges.
Weight and size restrictions may apply on internal flights and cruises. Baggage and personal items are at the owner’s risk throughout the travel program. You are responsible for checking baggage rules with the applicable airline(s) and cruise operator(s) for both internal and international segments.
TLDT reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. Travelers who do not wish their images to be used must notify us at the time of the booking or before the beginning of the program.
9.1 TLDT acts solely as an agent for you in arranging Services and is authorized to enter into contracts on your behalf with third-party service providers. TLDT does not itself provide transportation, accommodation, or other travel services (other than its agency services).
9.2 TLDT secures Services by establishing contracts between you and independent third-party providers. TLDT is not liable for the acts, omissions, or services of such third parties and makes no warranty regarding their standards or information. All bookings are subject to the terms, conditions, and liability limitations of those providers. Copies of relevant third-party terms are available on request.
9.3 TLDT, its employees, officers, directors, successors, agents, and assigns do not own or operate any entity providing transportation, accommodation, or other travel-related services. All such entities are independent contractors, and TLDT is not liable for their negligent or willful acts or omissions.
9.4 While TLDT exercises reasonable care in selecting suppliers, TLDT is not responsible or liable for injury, death, damage, loss, accident, delay, or irregularity arising from the acts or omissions of any carrier, hotel, cruise line, vehicle operator, or other third party, or from events such as cancellations, delays, sickness, weather, strikes, war, civil disturbances, terrorism, travel warnings or bans, quarantine, acts of God, or other causes beyond its control. All such losses are borne by the traveler.
9.5 TLDT is not responsible for delays, changes, or costs arising from incorrect, incomplete, or expired travel documents. In the event of cancellation, delay, or rescheduling due to causes beyond TLDT’s control, your remedies are limited to accepting any rescheduled or substitute arrangements offered, or receiving any recoverable amounts TLDT can obtain from suppliers on your behalf.
9.6 By traveling with TLDT, you voluntarily assume all risks associated with the trip and agree not to make any claim against TLDT, its related companies, officers, directors, or employees for injury, future medical condition, death, or other loss. This release is binding on all members of your party, your estate, and your heirs.
9.7 TLDT is not responsible for losses or expenses due to illness or injury, lack of medical facilities or practitioners, adverse weather, strikes, criminal acts (including theft), war, terrorism, computer system issues, or other such causes, nor for hazards associated with travel in remote or undeveloped areas, differing safety standards, or encounters with animals or allergens.
9.8 You agree to be bound by the conditions of carriage of all transportation providers. TLDT does not control or operate the equipment, personnel, or operations of these suppliers and is not liable for personal injury, death, property damage, delay, or inconvenience arising from (a) acts or omissions of suppliers or their agents, (b) defects or failures of equipment or vehicles, or (c) acts or omissions of any other party.
9.9 All services and accommodations are subject to the laws of the country in which they are provided. TLDT reserves the right, in its sole judgment, to modify itineraries, withdraw trips, or decline or remove any person from a tour when deemed necessary for safety, comfort, or the general welfare of participants.
9.10 TLDT is not responsible for, and is not bound by, representations made by third-party representatives, unaffiliated travel agents, unaffiliated websites, or any other third party.
9.11 TLDT may substitute hotels, vehicles, ships, or activities as required and may cancel, delay, or reschedule any tour prior to departure. Where such changes are not due to events beyond our control, you may be entitled to a refund of monies paid, less any non-refundable deposits or unrecoverable expenses.
9.12 Without limitation, TLDT is not responsible for injury, loss, death, delay, inconvenience, or damage to personal property arising from acts of God or force majeure, illness, disease, war, civil unrest, insurrection, animals, labor disputes, criminal or terrorist acts, overbooking or downgrading of services, food poisoning, mechanical failures, or failure of transportation to arrive or depart on time.
9.13 Information we provide regarding Services is often supplied by third-party providers. TLDT is not responsible for inaccuracies in such information and recommends that you confirm critical details directly with the relevant provider.
10.1 If any issue arises during your trip, you must promptly notify the relevant supplier (e.g., hotel, cruise, local operator) so they have an opportunity to resolve it. If the issue remains unresolved, you should contact TLDT by telephone as soon as possible. Failure to do so may limit both the supplier’s and TLDT’s ability to assist and may affect your rights under these Conditions. If your complaint is not resolved to your satisfaction, you must submit a formal written complaint to TLDT within 30 days of the last day of your trip, including your booking reference and relevant details.
10.2 Refunds are not provided for missed services except in verifiable extenuating circumstances, as determined at TLDT’s sole discretion (“Verifiable Claim”). To be considered, a Verifiable Claim must be submitted in writing within 30 days of the end of your travel program and supported by documentation and/or a statement from the relevant operating company. Any adjustment will be based on the actual price of the affected services, not on a per diem basis, and will not cover unused sightseeing or meals. TLDT will not accept liability for claims received more than 30 days after the end of your travel program.
11.1 TLDT is not responsible for errors in airfare bookings made by independent third parties. Your confirmed documentation will contain flight details, and it is your responsibility to ensure that arrival and departure times and cities are correct. Certain airfares may be subject to service fees and may carry change or cancellation penalties.
11.2 Airlines are responsible only for services provided while you are on board their aircraft or conveyances. International air carriers are subject to international conventions that limit their liability; the applicable conditions are set out in the carrier’s contract of carriage and ticket terms.
11.3 TLDT is not responsible and will not compensate you if changes to your flight schedule prevent you from enjoying all or part of your trip. TLDT is not liable for any carrier cancellation penalties incurred on non-refundable tickets. Baggage and personal items remain your sole responsibility.
11.4 Under EU regulations, you may have rights to compensation or refunds from airlines in cases of delays, cancellations, or denied boarding. Any such reimbursement from an airline is separate from, and does not automatically entitle you to, a refund from TLDT.
11.5 Any compensation or refund from TLDT will be determined under these Conditions. If you receive payment from an airline for the same event, that amount may be deducted from any payment due from TLDT.
11.6 For air/sea packages arranged by cruise lines, TLDT does not control flight times, routing, seat assignments, or carriers. Flight schedules, including whether flights are non-stop or require overnights, are determined solely by the cruise line. If you have specific flight requirements, you may request an “air deviation” (which may incur a non-refundable fee) or book a cruise-only package and arrange your own air.
12.1 TLDT is not responsible for operational errors, changes, or interruptions made by any cruise operator. Your confirmed documentation will contain cruise details, and you are responsible for verifying arrival and departure information for cruise start and end points.
12.2 Cruises may use onboard service providers (such as medical staff, spa personnel, or entertainers) who operate as independent contractors. Their services are optional and contracted directly between you and the provider. TLDT is not responsible for their acts, omissions, or services.
12.3 Cruises may offer shore excursions or other land-based services that are owned or operated by the cruise line or third parties. TLDT is not responsible for the operation or quality of these services; responsibility lies with the cruise line or the relevant provider.
12.4 Any onboard products or services (including gift shops, bars, specialty dining, or optional activities) are optional and will incur additional charges payable directly to the cruise line or onboard provider.
12.5 In addition to the general limits on responsibility in Section 9, cruises and vessel charters may be affected by factors outside TLDT’s control, including mechanical issues, crew availability, illness, weather, water levels, and itinerary changes. TLDT acts solely as a booking agent for cruises and is not liable for the operation, modification, or cancellation of any cruise itinerary, or for missed cruise departures or services due to flight or other delays.
12.6 You are also subject to any rules, regulations, passenger bills of rights, policies, and terms and conditions imposed by each cruise line (“Cruise Line Rules & Regulations”). It is your responsibility to obtain, review, and comply with these rules. TLDT is not responsible for their content or for any impact they may have on your travel program.
12.7 The captain of the vessel may amend the itinerary at any time for reasons including but not limited to weather and operational safety. Such changes may be necessary to protect passengers and crew. In these circumstances, TLDT and the ship’s crew will make reasonable efforts to accommodate you; however, no compensation will be provided for changes made for safety or operational reasons.
13.1 Each villa (“Villa”) is owned and/or operated by an independent third party (“Villa Owner”). TLDT does not own the Villas and acts only as booking agent.
13.2 Villas are provided solely for residential use by you and any guests approved by TLDT for the period specified in your travel program. The number of guests may not exceed the number stated in your itinerary without prior written approval. Events such as parties, weddings, or receptions that increase neighborhood traffic require prior written consent from TLDT and may involve additional requirements and fees.
13.3 Decorative items and furnishings in the Villa may differ from any photos shown on the Website or in marketing materials.
13.4 Pets are not allowed unless expressly permitted in your booking confirmation or reservation voucher.
13.5 The use of firecrackers and fireworks is strictly prohibited.
13.6 Except for pre-approved supporting personnel (such as chefs or housekeeping), you may not engage outside service providers at the Villa without TLDT’s prior written permission. TLDT may deny entry to unapproved providers and is not responsible for any losses arising from cancellation of their services.
13.7 The Villa is non-smoking indoors. If you smoke outside, you must use the ashtrays provided.
13.8 The Villa Owner may enter the property for inspection with reasonable prior notice. Supporting personnel (e.g., chefs, maids, gardeners, pool/jacuzzi maintenance) may enter at pre-agreed times. You will be informed of scheduled visits where applicable.
13.9 At the end of your stay, the Villa must be left in a reasonably clean and tidy condition. Excessive cleaning requirements, as determined by TLDT or the Villa Owner, may be deducted from your security deposit.
13.10 You may not change the setting or decoration of the Villa, including furniture placement, without the Villa Owner’s consent. Interior furnishings must remain inside, and exterior furnishings must remain outside. Unauthorized rearrangement may result in cancellation of your stay and forfeiture of your security deposit and program cost.
13.11 You are liable for any damage to the Villa or its contents, including gardens and external structures, and for any removed or destroyed items. Villa items (including linens and decorative objects) must remain at the Villa.
13.12 You and your guests must not expose the Villa or surrounding structures to fire hazards or dangerous materials (e.g., explosives, pressurized gas bottles, scuba tanks). You are responsible for any resulting damages under applicable local law.
13.13 Neither TLDT nor the Villa Owner is responsible for accidents, injury, death, or other losses in connection with your occupancy of the Villa. By paying your booking deposit, you accept these Villa terms and waive future claims against TLDT and the Villa Owner for such events.
13.14 If the Villa includes a swimming pool or jacuzzi, you assume full responsibility for use in and around these facilities and waive any future claims against TLDT and the Villa Owner in the event of accident, injury, or death.
13.15 You are fully responsible for your personal property and valuables at the Villa. Neither TLDT nor the Villa Owner is liable for theft or damage, nor for the acts or omissions of supporting personnel.
13.16 Unless otherwise approved in writing by the Villa Owner, a maximum of two persons per bedroom is allowed. Exceeding this limit may result in additional fees or removal of guests without refund.
13.17 You must personally occupy the Villa and may not sublet it or any portion of it.
13.18 You are responsible for complying with all applicable local by-laws and regulations, including noise and disturbance rules.
13.19 Unless expressly permitted in writing by TLDT or the Villa Owner, animals are not allowed in or around the Villa.
13.20 Neither TLDT nor the Villa Owner is responsible for roadworks, construction, or external disturbances near the Villa.
13.21 Security Deposit – Condition of Villa: Your security deposit will be refunded after your departure, provided all Villa rules are followed and no damage or excessive cleaning is required. Any pre-existing damage or issues must be reported to TLDT on the day of arrival; otherwise, damages discovered during or after your stay will be deemed your responsibility.
13.22 Security Deposit – Refund: If no damage or excessive cleaning is identified at the end of your stay, the security deposit will be refunded after departure, in accordance with the Villa’s specific rules and timelines as communicated in your documentation.
13.23 TLDT is not responsible for operational errors or issues in the running of any Villa. Your confirmed documentation will contain Villa details, and you are responsible for ensuring arrival/departure details and compliance with Villa rules.
There are inherent risks in travel and in certain activities, including but not limited to hiking, walking safaris, climbing, altitude exposure, wildlife encounters, limited access to medical care, and challenges in evacuation from remote locations. You acknowledge and accept these risks and assume full responsibility for participation in such activities.
It is your responsibility to review current travel advisories and warnings (for example, via the U.S. Department of State at www.travel.state.gov or by phone at 1-888-407-4747). If you choose to travel to a destination subject to a travel advisory or warning, you do so at your own risk and assume all responsibility for personal injury, death, or property damage arising from the conditions described in such advisories or warnings.
You represent that neither you nor anyone traveling with you has any condition or disability that could create a hazard to yourself or others on the trip. TLDT reserves the right to decline to accept or to remove from a trip, at the traveler’s sole expense, any person whose condition or behavior is deemed to pose a risk or materially impact the enjoyment or safety of other participants.
Approximately four weeks prior to departure, you will receive trip details and, where applicable, flight confirmations. Most tickets will be issued as e-tickets, though paper tickets may occasionally be sent by mail. Your itinerary or financial summary is not a valid travel document. You must have valid tickets before departure, or the airline may require you to purchase new tickets. If you encounter any documentation issues or emergencies, contact TLDT using the 24-hour emergency number provided in your final itinerary.
18.1 TLDT arranges travel programs using independent third-party suppliers, including accommodation providers, activity providers, airlines, cruise lines, transfer operators, shore excursion operators, guides, villa owners, and other entities (“Third-Party Suppliers”). These suppliers may in turn use local operators and subcontractors. TLDT does not control or supervise these suppliers and is not responsible for their acts or omissions.
18.2 Services provided by Third-Party Suppliers are subject to (i) their own terms and conditions, (ii) their liability limitations, and (iii) any applicable conditions of carriage, tickets, vouchers, international conventions, and agreements (collectively, “Third-Party Terms & Conditions”). These may limit or exclude the supplier’s liability.
18.3 You acknowledge that Third-Party Suppliers are expected to operate in compliance with applicable local laws and their own terms and conditions, but TLDT does not warrant such compliance and is not responsible for verifying it. TLDT is not liable for any claims, losses, damages, costs, or expenses arising from inconvenience, loss of enjoyment, disappointment, distress, or frustration (physical or mental) resulting from the acts or omissions of Third-Party Suppliers.
19.1 TLDT may occasionally need to amend advertised services or products. Minor changes (such as changes to flight times by 12 hours or less, carrier identity, aircraft type, or substitution of equivalent-standard accommodation) may occur before departure. We will use reasonable efforts to notify you in advance, but no compensation is payable for minor changes.
19.2 Our itineraries are based on major international carriers and typical schedules; delays may occur. TLDT is not responsible for, and will not compensate, additional costs due to delays (such as overnight accommodation or meals).
19.3 TLDT may cancel a booking due to force majeure events, supplier cancellations, or insufficient participant numbers. In such cases, TLDT may offer alternative arrangements or a refund of recoverable amounts, at its discretion.
19.4 TLDT reserves the right to withdraw a tour, alter itineraries or inclusions, or change sightseeing arrangements when necessary due to unforeseen circumstances or events beyond its control. Every effort will be made to operate tours as planned, but changes may occur after final documents are issued. Where changes are made by providers (e.g., to itineraries, accommodations, or services), TLDT will endeavor to notify you promptly.
You agree to:
Non-compliance may result in termination of services without refund.
21.1 By opting in to receive SMS messages, you consent to receive text communications related to TLDT services. Phone numbers collected for SMS consent will not be shared with third parties for marketing purposes.
21.2 You may receive SMS messages related to your booking, inquiries, and customer support.
21.3 Message frequency may vary, for example up to approximately 15 messages per week depending on activity and itinerary changes.
21.4 Standard message and data rates may apply, depending on your carrier and plan, including for domestic and international messages.
21.5 You may opt out of SMS communications at any time by replying “STOP” to any message.
By providing personal information to TLDT, you consent to TLDT collecting, using, and disclosing your personal information and that of other travelers in your party. Where you request TLDT to book travel, TLDT may transfer personal information to third-party service providers and, for international travel, to overseas recipients, including airlines, transportation providers, accommodation providers, tour operators, and government or security authorities.
Service providers typically receive personal information in the country where they provide services or where they are based. TLDT may also transfer personal information to related entities and service providers outside the USA for the purposes of facilitating bookings and performing administrative or technical services on your behalf. Where personal information is transferred to such recipients, TLDT is not responsible for ensuring their compliance with U.S. or foreign privacy laws or for how they handle that information.
TLDT reserves the right to modify these Terms and Conditions at any time, without prior notice.
